Act 11 of 1921.

An Act to confer certain rights on the South African Stud Book Association in Swaziland, and to make provision for the protection of such rights and for matters relating thereto.

Short title.

  1. This Act may be cited as the Registration of Pedigree Livestock Act, 1921.

Interpretation.

  1. In this Act, unless the context otherwise requires—

       "Association" means the South African Stud Book Association incorporated in the Republic of South Africa under the Registration of Pedigree Livestock Act, No. 22 of 1920, of the Republic of South Africa;

       "farm livestock" includes horses (except thoroughbred horses), asses, cattle, sheep, goats, swine and ostriches;

    "Minister" means the Minister for Agriculture.

Rights of Association or Society.

  1. (1) The South African Stud Book Association shall have the right—

  1. to register pedigrees of farm livestock bred in or imported into Swaziland;

  1. to the exclusion of any other person or body of persons in Swaziland to issue certificates of registration of pedigrees of farm livestock and to publish such pedigrees in the form of stud, herd or flock books.

       (2) Rights similar to those conferred on the Association under the preceding subsection may mutatis mutandis be conferred by the Minister by notice in the Gazette on any breed record society or livestock society         which is incorporated in the Republic of South Africa, and is affiliated to the Association.

Cancellation of certificate.

  1. In the event of the Association or any society upon which rights have been conferred under section 3 having its certificate of incorporation cancelled or suspended under the provisions of the Registration of Pedigree Livestock Act, No. 22 of 1920, of the Republic of South Africa, the Minister may confer the rights held by the Association or by such society in Swaziland on such person or body of persons for such period and subject to such conditions as he may think fit.

False statement and withholding information.

  1. Any person who—

  1. makes any false statement in relation to the pedigree of any farm livestock intended for registration with the Association, knowing that statement to be false; or,

  1. wilfully or negligently withholds any information which is necessarily required for the proper registration with the Association of the pedigree of any farm livestock,

        shall be guilty of an offence and liable on conviction to a fine not exceeding two hundred emalangeni, or, in the discretion of the court, to imprisonment without option of a fine for a period not exceeding six                      months or both such fine and such imprisonment.

False certificates.

  1. Any person who, or body of persons which, issues any certificate purporting to register or to state the pedigree of any livestock, or which publishes in any form such pedigrees and thereby infringes the exclusive right conferred by this Act on the Association shall be guilty of an offence and liable on conviction to a fine not exceeding one thousand emalangeni.

Saving as to pedigrees.

  1. The exclusive privileges by this Act upon the Association shall not be construed as preventing an owner of farm livestock which has not been registered with the Association from stating in writing or otherwise the pedigree of such livestock:

        Provided that if he makes a false statement as to such pedigree, knowing it to be false, he shall be guilty of an offence and liable on conviction to a fine not exceeding two hundred emalangeni, or, in the

        discretion of the court, to imprisonment without option of a fine for a period not exceeding six months, or to both such fine and such imprisonment.
